TRADING TERMS

1. About Us

These Trading Terms (“Terms”) set out the conditions under which we sell products to you. By placing an order with Matador DIY, you agree to be bound by these Terms.

2. Our Contract With You

A contract is formed when:

• You place an order, and

• We accept it by sending an order confirmation email

We reserve the right to refuse orders where:

• Products are unavailable

• Pricing errors occur

• Fraud or misuse is suspected

Until acceptance, no binding contract exists.

 

3. Products and Availability

We make every effort to ensure product descriptions, prices, and images are accurate. However:

• Colours, packaging, and dimensions may vary slightly

• Stock levels may change without notice

If a product becomes unavailable after ordering, we will contact you and offer:

• A refund

• An alternative product

• A revised delivery date

 

4. Pricing and Payment

All prices are shown in GBP (£) and include UK VAT (where applicable).

We accept payment via:

• Credit/debit card

• PayPal

• Other payment methods available at checkout

Your payment is taken at the time of order. If a pricing error is discovered:

• We are not obligated to fulfil the order at the incorrect price

• We will contact you to confirm your instructions or issue a refund

 

5. Delivery

Delivery charges, methods, and timeframes are displayed at checkout. Delivery dates are estimates only.

We are not liable for delays caused by:

• Courier or postal services

• Events outside our control (see Section 11)

Risk in the goods passes to you upon delivery. Ownership passes only when payment is received in full.

If goods are returned undelivered due to an incorrect address or missed collection, redelivery charges may apply.

 

6. Your Right to Cancel (Consumers Only)

If you are a consumer, you have a legal right to cancel your order for most products within 14 days of receiving them, under the Consumer Contracts Regulations 2013.

To cancel, you must notify us via email at hello@diymatador.co.uk.

Exclusions

You cannot cancel or return:

• Customised, cut-to-size, or specially ordered items

• Products that are sealed for hygiene or safety once opened

• Goods that become mixed inseparably with other items

You must return goods in original condition. You are responsible for return postage unless we are at fault.

Refunds will be issued using your original payment method within 14 days of receiving returned goods.

 

7. Faulty or Damaged Goods

Your rights under the Consumer Rights Act 2015 apply.

If an item is faulty, damaged, or not as described, you are entitled to:

• A repair or replacement, or

• A refund if a repair or replacement is not possible

You must notify us within a reasonable time at hello@diymatador.co.uk with your order details and photos (if applicable).

 

8. Warranties

Some products may carry a manufacturer’s warranty. These vary by supplier and are not issued by Matador DIY unless expressly stated.

 

9. Limitation of Liability

To the fullest extent permitted by UK law, we are not liable for:

• Loss of business, profits, data, or goodwill

• Indirect or consequential loss

• Installation errors, misuse, or modifications of goods

Nothing in these Terms excludes liability for:

• Death or personal injury due to negligence

• Fraud or fraudulent misrepresentation

• Consumer statutory rights

 

10. Events Outside Our Control

We are not responsible for delays or failure to perform obligations caused by circumstances beyond our control, including:

• Strikes

• Delivery network failures

• Natural disasters

• Government restrictions

If such events occur, we will contact you with a revised timeline or options.

 

11. Customer Accounts

You must keep login details secure and inform us immediately of suspected misuse. We may suspend accounts if misuse or fraud is suspected.

 

12. Promotions and Discounts

Promotional codes, discounts, or offers:

• Are valid for limited periods

• Cannot be combined unless stated

• Have no cash value

We reserve the right to withdraw offers at any time.

 

13. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
